RE/MAX 2001 S.S. (hereinafter referred to as “THE AGENCY” or “THE BROKER”) is governed by the Act Respecting the Protection of Personal Information in the Private Sector (CQLR, c. P-39.1) (the Act).

Personal Information

Personal information is any information about a natural person that allows them to be identified, directly or indirectly. A written document, image, video, or audio recording may contain personal information. In the course of its professional activities, THE AGENCY or THE BROKER may collect personal details such as name, home address, date of birth, ID information, social insurance number, income data, marital status, etc.

Consent

THE AGENCY or THE BROKER collects, uses, and discloses personal information with the consent of the individual concerned. For consent to be valid, it must be clear, free, informed, and given for specific purposes. A person who agrees to provide their personal information is deemed to consent to its use and disclosure for the purposes for which it was collected.

Anyone may withdraw their consent at any time regarding the collection, use, or disclosure of their personal information by THE AGENCY or THE BROKER. However, if the collection is necessary for the completion or execution of a contract, THE AGENCY or THE BROKER may be unable to fulfill a service request.

Responsibility

THE AGENCY or THE BROKER is responsible for protecting the personal information it holds in the course of its real estate brokerage activities. To this end, policies and practices have been implemented to govern the collection, use, disclosure, retention, and destruction of personal information.

Collection of Personal Information

Only information necessary for real estate brokerage activities is collected. This may include data required for real estate transactions, recordkeeping, oversight by the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ), or other purposes communicated to the person giving consent.

Personnel are encouraged to clearly explain to individuals the reason for collecting their data and to use OACIQ standardized forms. Personal information may also be collected verbally or through various documents involved in real estate transactions (ID, financial documents, powers of attorney, etc.).

Use and Disclosure of Personal Information

Personal information is used and disclosed only for the purposes for which it was collected and with the individual's consent. In certain cases defined by law, it may be used for other purposes, such as fraud prevention or customer service.

THE AGENCY or THE BROKER may disclose information to third parties—such as suppliers, contractors, agents, insurers (e.g., FARCIQ), professionals, or regulators, including those located outside of Québec—without consent if required to fulfill a mandate or contract. In such cases, protective measures must be specified in writing, and the third party must agree to cooperate in the event of a data breach.

Before disclosing information outside Québec, THE AGENCY or THE BROKER assesses the sensitivity of the data, the intended use, and the protections offered in the receiving location. Personal data will only be shared if adequate protection is confirmed.

Retention and Destruction of Personal Information

Once the purposes for which data was collected or used are fulfilled, it must be destroyed, subject to legal retention requirements. Real estate professionals are obligated to retain records for at least six (6) years after closure.

Security Measures

THE AGENCY or THE BROKER implements necessary security measures to protect the confidentiality of personal information throughout its lifecycle.

Privacy Incident

A privacy incident refers to unauthorized access, use, disclosure, or loss of personal information, or any breach of data protection.

A protocol is in place for managing such incidents, including roles, responsibilities, and specific actions to ensure the security of the data.

Roles and Responsibilities

1. THE AGENCY or THE BROKER

  • Ensures confidentiality through sound information management practices.

  • Issues directives, training, and instructions regarding data handling.

  • Implements appropriate safeguards to prevent breaches.

  • Standardizes document storage and retention practices.

  • Manages physical and IT access to data according to sensitivity.

  • Ensures secure destruction of data, including methods and timelines.

2. Privacy Officer

THE AGENCY or THE BROKER has appointed a Privacy Officer responsible for ensuring compliance with the Act and this policy. The officer manages privacy incidents, handles access and correction requests, reviews privacy-related complaints, and is consulted for projects involving personal data. 3. Staff Members

Staff may access personal data only when necessary to perform their duties. They must:

  • Maintain data integrity and confidentiality.

  • Follow all internal policies and directives on data access, use, communication, and destruction.

  • Use only authorized software and equipment.

  • Ensure secure data destruction.

  • Immediately report any suspected or actual security breaches.

Access, Withdrawal, and Correction Rights

An individual (or their authorized representative) may request access to, or correction of, their personal information. Consent may be withdrawn at any time in writing. THE AGENCY or THE BROKER may deny such requests in specific cases outlined by the Act.

Complaints

Individuals who believe their personal data has been mishandled may file a complaint. The Privacy Officer will review it diligently within 15 days and respond in writing.
